General Conditions of Sale – BE GLAM
Article 1 – Scope of application These General Terms and Conditions of Sale (GTC) exclusively govern sales made on the BE GLAM website between the seller and any natural or legal person making a purchase on the website, hereinafter referred to as “the Customer”. Any order placed implies the Customer’s unreserved acceptance of these GTC.
Article 2 – Products The products sold on the BE GLAM website are described with the greatest possible accuracy. Photographs, illustrations and text descriptions are provided for information purposes only and do not engage BE GLAM’s liability in the event of minor variations or errors that do not substantially modify the essential characteristics of the products.
Article 3 – Orders The Customer must follow the steps indicated on the site in order to validate his order. Any order validated by the Customer constitutes a firm and definitive acceptance of these General Terms and Conditions. BE GLAM reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to the payment of a previous order.
Article 4 – Prices Product prices are displayed in euros (€), all taxes included (TTC), and exclude shipping costs. BE GLAM reserves the right to modify its prices at any time, but products will be invoiced based on the rates in effect at the time the order is validated.
Article 5 – Payment Payment for orders is made exclusively by the means offered on the BE GLAM website (credit card, PayPal, etc.). The Customer guarantees that they have the necessary authorizations to use the chosen payment method. The order will only be shipped after effective confirmation of payment.
Article 6 – Delivery Deliveries are made to the address indicated by the Customer when ordering. The delivery times indicated on the site are estimates and not guaranteed. BE GLAM cannot be held responsible for delays caused by the carrier or by circumstances beyond its control. The Customer is required to check the condition of the package upon receipt and to immediately report any anomalies to the carrier and BE GLAM.
Article 7 – Right of withdrawal In accordance with current legislation, the Customer has a period of 14 calendar days from receipt of the products to exercise their right of withdrawal without having to justify their decision or bear any costs other than those related to the return of the product. The product must be returned in its original condition, complete (packaging, accessories, instructions, etc.) and accompanied by a copy of the purchase invoice.
Article 8 – Guarantees and liability The products offered on the BE GLAM website benefit from the legal guarantee of conformity provided for by Articles L.217-4 to L.217-14 of the Consumer Code and the guarantee against hidden defects provided for by Articles 1641 to 1649 of the Civil Code. In the event of a defective or non-compliant product, the Customer must immediately report the problem to BE GLAM by email. BE GLAM's liability is limited to replacing or refunding the product concerned.
Article 9 – Limitation of liability BE GLAM cannot be held liable for indirect damage caused to the Customer or a third party, resulting from improper use of the products sold, nor for any commercial or financial loss.
Article 10 – Protection of Personal Data BE GLAM processes the Client's personal data in accordance with the General Data Protection Regulation (GDPR) and the amended Data Protection Act. The Client has the right to access, rectify, erase, limit the processing, transfer, and object to the processing of their personal data. To exercise these rights, the Client may contact BE GLAM via the email address indicated in the legal notices.
Article 11 – Intellectual Property All elements of the BE GLAM website (texts, photos, images, logo, trademarks) are protected by intellectual property legislation. Any reproduction or use without prior written authorization is strictly prohibited.
Article 12 – Applicable law and disputes These General Terms and Conditions are subject to French law. In the event of a dispute relating to the application, interpretation or execution of these General Terms and Conditions and after an attempt at amicable resolution, only the French courts will have jurisdiction.
